TERMS & CONDITIONS Warranty: The Panoptx/7EYE warranty covers non-prescription product for one year, prescription frames for one year, and prescription lenses for six months from the date of purchase. The Panoptx/7EYE warranty covers defects in materials or manufacturing. It does not cover scratched lenses, or damage from misuse. The warranty is valid only for products manufactured and assembled by Panoptx/7EYE and sold by an authorized Panoptx/7EYE Dealer. Damaged product without proof of purchase or that is not a manufacturing defect will be subject to repair charges. Prescription products purchased from Panoptx/7EYE should be returned to Panoptx/7EYE for repair. The product returns should be clearly marked “prescription”. Any prescription products not produced by Panoptx/7EYE must be returned to the place of purchase for repair. Panoptx/7EYE makes every effort to ship your product according to the estimated lead times provided by the Store at checkout. We can not guarantee that this will always be the case. The estimated lead times are in business days (Monday through Friday, excluding federal holidays). Repair: Panoptx/7EYE will make the best effort to repair the damaged product outside of warranty coverage within two years from purchase. Our repair offer is subject to part availability and cannot be guaranteed. Product Availability: Panoptx/7EYE makes every effort to supply you with the products you order, but there may be occasions when orders are confirmed but we cannot supply the ordered products, either at all or in the quantities ordered. In those circumstances, Panoptx/7EYE will attempt to contact you to inform you and, if you are interested, we may suggest alternative products that might meet your needs. Returns: If you wish to return product purchased on the Panoptx/7EYE website, mail product to Attn: Returns 1252 Quarry Lane Suite A, Pleasanton, CA 94566 within 14 calendar days of the receipt of the product. Panoptx/7EYE recommends that you ship using a traceable method. Order Processing: Panoptx/7EYE will begin processing the orders placed on weekends or holidays on the next business day. Business days are Monday through Friday, excluding federal holidays. Credit cards are charged automatically at the time of placing the order on the website. Other Terms and Conditions: Panoptx/7EYE reserves the right to change the terms and conditions of sale at the Panoptx/7EYE Store at any time. Panoptx/7EYE may make changes to any products or services offered at the Panoptx/7EYE Store, or to the applicable prices for any such products or services, at any time, without notice. The information provided at the Panoptx/7EYE Store with respect to products and services may be out of date, and Panoptx/7EYE makes no commitment to update the information provided at the Panoptx/7EYE Store with respect to such products and services. Panoptx/7EYE reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Panoptx/7EYE Store, or to any portion of the Panoptx/7EYE Store, for any reason; (2) to modify or change the Panoptx/7EYE Store, or any portion of the Panoptx/7EYE Store, and any applicable policies or terms; and (3) to interrupt the operation of the Panoptx/7EYE Store, or any portion of the Panoptx/7EYE Store, as necessary to perform routine or non-routine maintenance, error correction, or other changes. To the extent permitted by law, all sales at the Panoptx/7EYE Store are governed by California law, without giving effect to its conflict of law provisions. No Panoptx/7EYE employee or agent has the authority to vary any of the Panoptx/7EYE Store's policies or the terms and conditions governing any sale. If any of the aforementioned policies are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such policy shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of the policy, so that the policies shall remain in full force and effect. Panoptx/7EYE’s failure to insist on or enforce strict performance of these policies shall not be construed as a waiver by Panoptx/7EYE of any provision or any right it has to enforce these policies, nor shall any course of conduct between Panoptx/7EYE and you or any other party be deemed to modify any provision of these policies. These policies shall not be interpreted or construed to confer any rights or remedies on any third parties.
